Child Custody Utah

child custody utah

Child custody and legal guardianship are legal terms which are used to describe the legal and practical relationship between a parent and his or her child, such as the right of the child to make decisions and the parent’s duty to care for the child.

Following ratification of the United Nations Convention on the Rights of the Child in most countries, such as Utah and have superseded the concepts of “custody” and “access”. Instead of a parent having “custody” of or “access” to a child, a child is now said to “reside” or of “contact” with a parent. For a discussion of the new international nomenclature, give us a call to discuss it in a free consultation.

Residence and contact issues typically arise in proceedings involving divorce (dissolution of marriage), annulment, and other legal proceedings where children may be involved. In most jurisdictions the issue of which parent the child will reside with is determined in accordance with the best interests of the child standard.

Utah Courts Determine Child Custody

The support order will be based on the child’s needs, obligor’s ability to pay, custody arrangements and the child support guidelines. In Utah, The Criminal Code makes it an offence to abduct a child to spite a custody order. A custody order establishes both the custody and parenting time arrangement for the children. Your child custody order is also confidential.

When an unmarried mother has a child, the mother has legal custody of that child until a court says otherwise.

During divorce, marriage, or annulment proceedings, the issue of child custody often becomes a matter for the court to determine. The Court must consider the following factors in every child custody decision under the law regarding the best interest of the child. The court retains the power to alter the custody arrangements until the child turns 18 or is emancipated.

You may contest custody, child support, and alimony and property division by appearing in court and filing appropriate legal papers. At the hearing, the court shall hear evidence to determine whether the child custody and support determination should be modified. The fact that one parent has been the child’s primary caretaker is often considered but is not enough to guarantee a custody award. It is not that unusual for middle class parents to spend $60,000 on a divorce and child custody fight. Traditionally, divorce in the Utah results in one parent being awarded primary custody and decision making for a child.

Child Custody Rights

Each parent shares the rights and responsibility for the care, custody, companionship, and support of their children. In salt lake city Utah, have fathers rights groups specifically dedicated to helping fathers obtain custody of their children

Legal child custody includes the right to make decisions about the child’s education, religion, health care, and other important concerns. A child may be placed in foster care while a custody case is pending. Legal custody means the right to determine the child’s upbringing, including education, health care, and religious training.

Child Custody Conclusion

Physical custody and residence means the routine daily care and control and where the child lives. Physical child custody is awarded to one parent with whom the child will live most of the time. In most cases, both parents continue to share legal child custody but one parent gains physical child custody. There is also a presumption that it is in the child’s best interest to be in the custody of a parent over a non-parent. Parent time in Utah (also called visitation rights) allow the non-custodial parent (the person without child custody) time to spend with their child. A common arrangement is that one parent gets custody of the child and the other parent is given visitation rights.

When you are ready to move forward with a child custody case, or if you want to modify or change a current child custody order in the State of Utah, call us for a free consultation

Land Use

land use

The Federal and State governments of the United States of America have years ago demarcated different lands or large chunks of property for specific development purposes. Some of them may be for Federal or State use whilst others would be for community and commercial development, townships, extensions of the urban areas of the nearest city among many other proposed plans but which are still on the drawing boards. In Salt Lake, you’ve got to go through the Zoning and Land Use Department at the County Level for sure. We help developers and land owners with their issues with zoning and land use.

For instance, if a land is specifically earmarked and planned as a residential area and is presently empty and barren you would not be permitted to buy and acquire land within that area and start a factory to manufacture something. These are zoning and land use laws that each city and county regulate. Depending on the type of manufacturing plant you intend on building, you may need to deal with the EPA or Salt Lake County Board of Health.

Even if you could acquire the land from private owners who would know that it is planned for specific development projects they would still sell it to you and get rid of their problem and are required to disclose such details to you if you ask for it but when you start the basics of making the plans to get your proposed project off the ground you could be in for legal trouble.

Accordingly, it would be prudent on your part to have all the information pertaining to the real estate that you are planning to acquire especially the specific zoning laws before you go ahead and acquire any real estate anywhere.

New York City was the first to adopt the zoning initiative and promulgate laws in 1916 but since then all municipalities, local councils, States and the Federal government follow suit. In Utah, you must check with the County and the City to determine what you intend to use the property for is approved and valid. You might have to file a change of use permit or get a variance.

Any land anywhere would be encompassed into a specific zone and it would be the prerogative of the buyer to initiate action to find out for what purpose the land they are interested in purchasing is zoned for, before acquiring it for the development that they have envisaged and planned.

If you are moving forward with a project, you ought to call the lawyers at Ascent Law to advise you on the zoning laws of the respective city which would invariably be within the jurisdiction of the property. We can assist you with the State authorities and County Planning Commissions as well.

Both zoning laws and the prevailing real estate within the jurisdiction of the respective authority are intertwined so you cannot ignore one and just comply with the other. You need to take care of all issues before you start.

What are Unfair Business Practices in Utah?

what are unfair business practices in utah

If you are a business owner, knowing the ins and outs of fair and unfair business practices are important. If you are careful about being aware of what is unfair, you are much more likely to avoid disputes and lawsuits, which, for obvious reasons, is good for your business.

The Unfair Practices Act

If you own a business in Utah, you ought to be very aware of the Unfair Practices Act that Utah has in place. This act is designed to protect consumers from being discriminated against, taken advantage of, and from unfair competition.

The details of this act may be found here but the main points of unfair practices that this act protects against are:

● Discrimination in price between different purchasers of commodities of like grade and quality

● Paying or accepting anything of value as compensation, or any allowance or discount in lieu thereof, except for and not exceeding the actual cost of such services rendered in connection with the sale or purchase of goods

● Discrimination in favor of one purchaser against another purchaser

● Advertising goods you are not prepared to supply

Avoiding Unfair Business Practices

It is, of course, natural to want to have a successful business that accrues plenty of profit. Some unfair practices may even seem like a logical way to boost your revenue. Nevertheless, these practices should be avoided at all costs, otherwise your business may be subject to legal consequences.

Additionally, it is also important to be familiar with the laws so you do not inadvertently infringe upon them. Knowing what you can and cannot do when advertising, the types of things that you must disclose to your customers, and other such guidelines can save you from having to deal with lawsuits over unfair business practices.

Keep the following guidelines in mind when advertising and selling products to your customers:

● Ensure information about price, value, and quality is not misleading.

● Ensure that any disclaimers are prominent and visible, not obscured by images, graphics or text, and do not undermine or contradict the main offer.

● Ensure that any promises, opinions, or predictions are true or have reasonable grounds to be true.

● Ensure that you give consumers enough information to make an informed choice. Do not remain silent about important facts regarding your goods or services.

● Ensure that your advertisements are not offensive.

● Ensure that you do not make false or misleading claims about the characteristics of your goods or services.

● Ensure that you provide any gifts, rebates or prizes that you offer. They must match their advertised description.

● Ensure that you keep a reasonable supply of any sale items you advertise.

● Ensure that you never take advantage of a vulnerable person.

● Ensure that you always act in good conscience.

● Ensure that you do not use undue pressure, influence or unfair tactics to force a consumer into an unreasonable contract.
